fee recovery for paralegal work: orange county lawyer article ...
Fee Recovery For Paralegal Work: Orange County Lawyer Article Surveys Some Federal Decisions Where Paralegal Compensation Was Successfully Opposed Or Limited In Recovery Proof of Paralegal Status and Compliance with Education/Certification Requirements Are Musts. In our June 4, 2008 post, we discussed federal and state decisions that generally allowed paralegal time to be compensated under the EAJA or many California fee-shifting statutes. An interesting article, authored by Kirstin Simonson, has appeared in the November 2008 issue of the Orange County Lawyer. We briefly review the [more...]

Failure To Comply With “Declaration Of Disclosure” Requirements: A spouse who has complied with the statutory “declaration of disclosure” requirements in marriage dissolution proceedings (Ca Fam § 2100 et seq.) has various statutory remedies against the other spouse who has failed to comply. One such remedy is a motion to compel a further response (Ca Fam § 2107(b)(1)). If the noncomplying spouse fails to file a sufficient response, the complying spouse may seek monetary sanctions “in addition to any other remedy provided by law” (Ca Fam § 2107(c))–including an OSC re [more...]

The first doctor had me fill out and sign a medical release form, worthy of a bar exam question. The doctor's pleasant, yet useless, administrative assistant took my signed medical records release and informed me that it would be at least two weeks before the records would be sent, since they outsource that task to a private company that only comes to work every two weeks. About a month later I called my new doctor to confirm that the records came and to schedule an appointment. His administrative assistant informed me that the first doctor sent a copy of my medical release form and [more...]

Attorney fees awards in California Family Law proceedings
Virtually all attorneys who work in California Family Law cases are aware of the fact that the Courts can order another party to pay their client’s attorney fees and costs. However, many are not aware that the Courts have the power to order that the other party to the proceeding pay a reasonable amount to allow a party who is “In Pro Per” to retain an attorney in a timely manner before proceedings in the matter go forward. The relevant statutes are contained in Chapter 3.5 of the California Family Code, sections 2030 through 2034. These statutes can be very useful when used in the right [more...]

Legal Document Assistants were once commonly known as Independent Paralegals. However, as of January 1st, 2000, only those Paralegals working directly for attorneys may now be referred to as Paralegals. Those formerly known as Independent Paralegals are now officially known as Legal Document Assistants (LDA's). ((B&PC Section 6400), California SB 1418) One might infer that post-2000, AAA California Aid should not be referenced as a "paralegal services company." Entirely separately, one ponders whether some analog of a "legal document assistant" might ever evolve in the patent application [more...]

Paralegal Power to the People! Santa Monica - Dean McAdams ...
After attending UCLA paralegal school and then working in law firms, insurance companies and reading law for over twenty years I understand how the entire system really works. The founding fathers of America never went to law school or took bar exams; they simply "read" law. After a hard day of splitting logs, Abraham Lincoln read Black's Law by the firelight and then went out and became a successful lawyer because Honest Abe solved people's problems for a very reasonable one silver dollar. And Abe may not have always filed a lawsuit to solve those problems, which is why I am so into [more...]

Family law for heterosexuals can be complicated; that is just as true for gay and lesbian families, who often must resort to sperm donors or surrogate mothers in order to become parents. Legal complications can arise from such arrangements, such as happened in Santa Cruz, California, when a lesbian couple broke up and the biological mother of their twin sons entered into a relationship with the man who had provided sperm for the boys’ conceptions. Complications also arose when a New Jersey couple, Sean Hollingsworth and his husband, Donald Robinson Hollingsworth, turned to Donald’s [more...]

CVT points out that in January, IDT settled a separate class action in federal court in Newark brought on behalf of hundreds of phone card customers who accused IDT of the same sort of deceptive marketing that the company is blaming on its rivals. In a settlement of the consumer class action, IDT denied wrongdoing but agreed to pay up to $20 million in refunds and improve disclosures on its own cards. CVT argues that IDT’s suit merely attempts to spread the pain. “They want everyone else to die, and they want to dominate the industry,” says CVT Co-Chairman Richard R. Roscitt. IDT’s [more...]

Nelson, to match an address under defendant Nelson’s control. Defendant Nelson made false representations to obtain documents from the State Bar, including a bar card, which he then used to reinforce the [more...]

What is the Unauthorized Practice of Law (UPL)?: Lawyers ...
In the not too distant past in these states, public paralegals who accepted fees to type simple legal documents for people representing themselves in court were routinely charged with UPL, run out of business and/or jailed. Today the profession is accepted, regulated and praised in both states. Legal document preparers in Arizona must go through an extensive background check, pass a lengthy exam and attend CLE classes yearly. Legal document assistants in California must register with the courts where they assist people and carry a $25,000 errors and omissions bond. The profession is [more...]

Paralegal Wins Legal Ruling Regarding Deceptive Advertising
In California, as Paralegals we cannot complete paperwork on behalf of ‘clients’ without an attorney’s review and approval, unless we are a Legal Document Assistant, known as LDA. An LDA is not the same as a Paralegal. Pursuant to Business and Professions Code §6401(b) a Paralegal does not have to register as a Legal Document Assistant while acting on behalf of a member of the State Bar. A Paralegal, acting independently of an attorney, must register as a Legal Document Assistant if performing services to the general public. For those paralegals who want to be independent and have their own business, we become Legal Document Assistants and register with our county. We're required to have criminal background checks. It's the law! LDA's don't give legal advice, we merely direct self represented people to sources where they can obtain general law so we can prepare their legal forms. We then type their legal forms and file them with the court. In other words, LDA's are not supposed to apply the facts of one's case to the law or visa versa. This would be called the "Unauthorized Practice of Law". This is an excerpt of [more...]

The Alliance of Legal Document Assistant Professionals (ALDAP) is sponsoring this seminar as a forum for discussion among LDAs and freelance paralegals, and to facilitate enforcement of the consumer protections afforded under California law. California and Arizona, among others, require state certification of anyone who prepares or assists in the preparation of legal documents. Other states require continuing education criteria that must be met and reported to governing agencies in order for paralegals to remain employed. In truth, the most effective form of competency assurances should be offered by paralegal employers. The lawyers who use their services must be able to rely on accurate, well documented information that will stand up to the rigors of the legal system.
